By accessing our services*, you agree to abide by the terms and conditions outlined below. If you do not agree and accept the terms and conditions outlined below, you are not permitted to access our services*.

*Unless otherwise stated, services refers to any interface provided by Smart Hearts, such as our website(s), dating app, metaverse, NFT sale, and other interfaces.

1. OWNERSHIP OF NFTS: Participating in our non-refundable NFT sale grants you 100% ownership of the NFT. We will never rescind ownership of your NFT. NFT ownership may be necessary to access our services; however, it does not guarantee access to our services. For example, your NFT may be banned from accessing our services either temporarily or permanently at any time for any reason, including inappropriate behavior with other members.

2. ACCESSING SERVICES:  All services are provided "as is" and "as available" and may be changed, altered or terminated at any time. Your NFT may be barred from accessing our services at any time for any reason deemed appropriate by Smart Hearts.

3. AGE: You must be at least 18 years of old to use our services.

​

4. LIABILITY: You are entirely liable for all consequences of using our services, including (but not limited to) the following:

  1. You are liable, and agree not to hold us liable for any fluctuations in the prices of cryptocurrencies and NFTs.

  2. You are liable, and agree not to hold us liable for any difficulties experienced with the Ethereum Blockchain.

  3. You are liable, and agree not to hold us liable for any unintended financial consequences, such as lost funds due to hackers or technology failures when accessing our services.

  4. You are liable, and agree not to hold us liable for any difficulties and failed transactions when accessing our services, including our NFT sale.

  5. You are liable, and agree not to hold us liable for the execution of our Smart Contracts. You agree to review all Smart Contracts and accept any unintended consequences of using our services.

  6. You are liable, and agree not to hold us liable for any consequences from interactions with other entity/entities and individual(s) when using our services, either in person or through our services. This includes and adverse and unintended results of interactions with other entity/entities and individual(s), including, but not limited to those met from our dating app.

5. MODIFICATION OF TERMS AND CONDITIONS: We may at any time modify our terms and conditions. Modifications will be effective immediately. You agree to regularly check our terms and conditions. If you do not agree with the modified terms and conditions, you may not access our services.

6. REFUNDS: We do not provide any refunds of any kind for our services. If you purchase a Smart Hearts NFT, either from our NFT sale or from a third party or otherwise, you are not entitled to a refund for your NFT, even if your NFT is banned, either temporarily or permanently from accessing our services.

7. JURISDICTION: You must be legally allowed to use our services, in accordance with the laws in your jurisdiction and United States Law. If you are not legally allowed to use our services, you are not permitted to use our services.

8. CRIMINAL BACKGROUND: You are not permitted to use our services if you have any criminal history of any kind, including minor misdemeanors or felonies.

9. YOUR OBLIGATIONS: By accessing our services, you agree to fulfill the following obligations:

  1. You agree to interact with others on Smart Hearts in an appropriate manner.

  2. You agree to interact with others on Smart Hearts in a way to make them feel comfortable and safe.

  3. You agree not to interact with others on Smart Hearts who make you uncomfortable or unsafe.

  4. You agree to report any suspicious or destructive behaviors to Smart Hearts.

  5. You agree to only meet with individual(s) or entity/entities using your own discretion.

10. INDEMNIFICATION: You agree to hold harmless and not responsible: Smart Hearts, its employees, officers, agents, licensors and other related parties from any claim, loss, damage and liability of any kind, including attorney fees related to our services or third party interactions related to our services.
